Bitjockey Terms of Service

These Terms of Service were last updated on January 30th, 2024. The most recent version of the TOS will override all previous versions.

1. Introduction

Welcome to Bitjockey. These Terms of Service ("TOS") form a legally binding contract between you ("User") and KANM Student Radio ("Company," "we," "us," "our'') regarding your use of our online platform. Please review these TOS carefully. If you disagree with these terms, you should not use our platform.

2. Acceptance of Terms

By accessing or using Bitjockey, you represent and warrant that you have read, understood, and agreed to abide by these TOS. These TOS embody the entire understanding between us and override any previous or concurrent agreements, whether oral, written, or in any other form, pertaining to the subject matter of these TOS.

3. License and Ownership

Subject to your agreement and ongoing compliance with these TOS, we grant you a limited, non-exclusive, non-transferable, and non-sub-licensable license to use Bitjockey for personal or business purposes. All rights, title, and interests in the software, including all associated intellectual property rights, belong to KANM Student Radio and/or its licensors. This license does not imply any ownership or transfer of rights in the software.

4. Usage Restrictions

By using Bitjockey the user agrees to comply with all applicable laws and policies governing the use of Texas information resources. You shall not reverse-engineer, decompile, disassemble, or attempt to discover the source code of our software, nor create derivative works from our software or use our platform for illegal or unethical activities. Unauthorized use of the platform may subject you to civil and/or criminal penalties, including potential financial damages. Usage may be subject to security testing and monitoring. Users have no expectation of privacy except as otherwise provided by applicable privacy laws. For further information, refer to Texas A&M University System Policy 29.01.03

5. User Content

When you upload or transmit any data, text, or other material through Bitjockey ("User Content"), you warrant that you have the necessary rights and permissions to use and authorize us to use all intellectual property rights in your User Content. You bear sole responsibility for ensuring that your User Content does not infringe any third-party intellectual property rights.

We reserve the right to review User Content, and any content found to infringe copyrights or not belong to the user will be removed immediately. Violations may result in termination of access to the platform, legal action, or both. These TOS do not grant us any ownership rights in your User Content, nor do they limit your rights to use and exploit your User Content, as long as such use aligns with these TOS.

6. Privacy

Your privacy is important to us. We adhere to the privacy policy of Texas A&M University, which is hereby incorporated into these TOS by reference. The Texas A&M University Privacy Policy explains how your personal information is collected, used, and safeguarded. Please refer to the Texas A&M University Privacy Policy for detailed information.

By accepting these TOS, you also agree to the terms of the Texas A&M University Privacy Policy. If you do not agree to both these TOS and the Texas A&M University Privacy Policy, you must not use Bitjockey. 7. Limitation of Liability

To the maximum extent permitted by applicable law, KANM Student Radio and its affiliates, officers, directors, employees, agents, suppliers, or licensors shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of your use or inability to use Bitjockey.

8. Indemnification

You agree to indemnify, defend, and hold harmless KANM Student Radio and its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising from your violation of these TOS or your infringement of any third-party rights, including any copyrights, property, or privacy rights.

9. Amendment of Terms

We may modify these TOS at our discretion. We will strive to notify you of any changes by posting the revised TOS on our website or through other appropriate means. You are responsible for periodically reviewing these TOS for changes. Your continued use of Bitjockey after the posting of changes will constitute your acceptance of such changes.

10. Governing Law and Jurisdiction

These TOS and any disputes arising out of these TOS or your use of Bitjockey will be governed by and construed under the laws of the United States of America, irrespective of its conflict of law provisions. Any disputes between you and the Company will be resolved in the United States of America, with you and the Company consenting to the personal jurisdiction of and exclusive venue in the state and federal courts within the United States of America, unless otherwise mutually agreed.

Bitjockey is a radio automation platform that delivers over 30 thousand licensed songs to the online radio community. It is currently a proprietary service of KANM Student Radio, and is, at the moment, only available to KANM DJs.
